RCL has always been generous with their humanitarian efforts.
When Irma tore through the Caribbean in 2017, my former manager was vacationing with his family in St Maarten and got trapped.  Adventure of the Seas arrived there to rescue stranded vacationers including his family.  It was quite the ordeal for them, from surviving the actual storm to being in fear for their lives as looters and gangs roamed the resorts (they heard many gunshots).  After nearly a week, they were finally picked up by a police caravan who escorted all the guests to the port.  They were told not to stray and above all, have their passports because they would not be getting on the ship without them.
Needless to say, he was overcome with gratitude to the crew and RCL for their efforts.

@Ray  That's the thing even 1st time cruisers cannot only see the different in the tinting, but you will feel the breeze come through even when at port.
I am with others that say she wiggled out of his arms, but still that does not alleviate the family from their culpability.
I just wish they stop with the remark that it was right next to the kids play area.  For people that have never cruised I can see them thinking the play area would be 5 feet away, when in reality everybody that has cruised knows there were probably at least 2 rows of loungers, than the knee wall to the area where they were at that had tables.  I assume their point is that since the splash zone was on that side those windows should remain locked.
I don't believe anyone with a heart does not feel sympathy for the entire family.  However, anyone with a brain would have a hard time finding Royal negligent.  For them to win a case against RCL they would have to get all of the jurors to never have been on a cruise.  Even then it would still be hard when they show up close pics of how high the hand rail is, how far they are placed from the windows, how they are tinted and angle out.
I would think the attorney knows this and his game plan is to keep RCL in the news in hopes that passengers will sail on another cruise line.  I would be really curious to see Disney's decks.  I am sure passenger ratio there are a lot more children on their ships.  That would be the only way I can see a win for them, that is, if Disney's pool deck windows never can open.

I’m still leaning towards the idea that he was holding her up so she could see out and she just wiggled loose and fell.  The whole “I didn’t know it was an open window” just isn’t believable.   It’s just a terrible, horrible, sickening accident. They happen every day.  But there is no way that this is the fault of the cruise line.  I hope they fight it.

I assume while the ship was docked in San Juan today, the investigators and lawyers did more investigating.  This is probably when Winkelman or his team got their first look at the actual area in question.  I'm looking forward to hearing an update from him saying, "Sorry, my bad.  I realize now how preposterous my theory was."  One can dream.

Time for someone to grow a set and stand up to these ambulance chasing lawyers!!
RC should just say " see you in court"
No out of court settlement! Let the facts and truth be heard! Maybe then it will reduce the amount of ridiculous lawsuits thats settled out of court.
The only reason people take such actions is they know it will more than likely end in settlememt making them richer even if it was their own fault.

This is what bother's me. We all know that if you pass or stand at one of these open windows that there is a wind that blows. How can you NOT know the window is open??? Moreover, wouldn't  you question why all the window panes are tinted but this one "supposed" pane isn't?? This idiot of an attorney is trying to spin the story but will end up losing at the long run. RCCL will most likely file a Motion for Summary Judgment should this attorney file suit as previously stated, grandfather admits to his negligence.

Just to be clear, are the windows talked about at chest level of this guy or the one where his legs are?  It looks like the windows where the guys legs are can slide open given the panel in the middle.  Can anyone that has been on the ship verify if these slide open too?

It's to do with the American law governing foreign-flagged ships not connecting two American ports unless it calls at a distant foreign port somewhere between the two. On such a short trip it's not's possible to call at a distant foreign port so it has to sail empty.
Pinging @twangster who explained this to me a while back when I had precisely the same question. He can explain it better than I have done.
