King (1922), the court ruled that schools could bar students who had not been vaccinated.  The court has also ruled that denying service to a customer is legal as long is it not because of a person's status in one of the following protected classes: race, color, religion, sex, or national origin.  The unvaccinated are not a protected class.  And federal law clearly has jurisdiction as the cruise lines are engaged in interstate commerce.  Health privacy laws don't apply because RCL is not your healthcare provider and it would be you who would be divulging your medical status.

    Now a new ruling could change this, but the court has (at least historically) been hesitant to overturn previous precedents.

    Clearly Celebrity either has an inside track they are working or are very confident in their legal standing.

    Nothing from Royal or Carnival yet. I live in Houston so I would LOVE a cruise out of Galveston instead of having to fly to Florida. Texas did not ban companies from asking for proof of vaccine so it should not be an issue here (just fyi they only banned it from companies who receive state funding, i.e. state sponsored companies).

    This is what I paid but I feel it is worth it. That is beverage package + wifi. Wifi alone is... $11/device/day. So in theory the drink package is $60 per day. At 10-12 per drink, that is only 5 drinks...

    I can definitely drink more than 5! I also personally love the idea that I prepay my drinks and while onboard I do not have to worry about the price of each and every drink I purchase. Definitely makes it more "all inclusive" feeling.

    Thank you Doug for the post in a Facebook group for the June 12th sailing. Updates below:

    Provided cruise ship operators with more discretion regarding fully vaccinated travelers. Provided additional discretionary considerations for ships with at least 95% of crew and 95% of passengers fully vaccinated.

    New Information I noticed:

    Mask Usage

    • Cruise ship operators, at their discretion, may designate areas as only accessible to fully vaccinated passengers and crew where masks and physical distancing are not required (e.g., casinos; bars; spas; entertainment venues; and dining areas, including self-serve buffets).
    • For ships with at least 95% of crew and 95% of passengers fully vaccinated, cruise ship operators, at their discretion, may advise passengers and crew that they do not have to wear a mask or maintain physical distance in any areas.

    Shore Excursions

    • Cruise ship operators, at their discretion, may advise passengers and crew that—if they are fully vaccinated—they may engage in self-guided or independent exploration during port stops. The cruise ship operator is additionally advised that foreign jurisdictions may have their own requirements.

    HIPAA only applies to covered entities. Covered entities are defined in the HIPAA rules as (1) health plans, (2) health care clearinghouses, and (3) health care providers who electronically transmit any health information in connection with transactions for which HHS has adopted standards. Generally, these transactions concern billing and payment for services or insurance coverage. For example, hospitals, academic medical centers, physicians, and other health care providers who electronically transmit claims transaction information directly or through an intermediary to a health plan are covered entities.

    If you give this information willingly to the cruise lines, they are not required by law through HIPAA to protect your data in that way. There is also nothing stopping them from "disclosing" your medical condition (or lack of vaccine) through a wristband or requiring a mask.

    Then just do not let them on board. Much less risk of a cruise being interrupted if everybody is vaccinated.

    Also HIPAA is a set of guidelines of how a company has to protect your medical data if they receive it from you or another source. If you volunteer your data over to them (I.e. giving them your vaccine status), I am not a lawyer, but I do not believe HIPAA works in this situation.

    You will participate in exercises to

     

    -Evacuate the ship

    -Room quarantines

    -Transfer mock-infected patients into isolation

    -Expect to wear a mask and social distance the entire time, whether you're vaccinated or not

    That sounds like a unique experience. Almost like a new excursion!

    If it's on the gov't letterhead or logo, I don't see why it'd be a problem to use that. That's really more "official" than what we get in the US, where we write in our own name/DOB, and they use return address label stickers with the vaccine name/lot/expiration

    Hopefully we can call Royal and get an answer. I am bringing the one from the US but I would think yours works too.
